Earlier this year a gamer filed a suit against Sony, claiming that his ban from the PSN infringed upon his freedom of speech. The male gamer was banned for harassing other players in Resistance, violating the PSN's user agreement.

More after the jump!

Last week a judge came to a ruling on the case. The Judge dismissed the case, stating that Sony was not violating the players 1st amendment rights. The ruling also concluded that typically freedom of speech protects you from the government, not private companies.

The banned gamer was also suing for emotional damages, but the Judge handed that down to the State. After the first ruling, it is unlikely that the Californian gamer will receive anything for damages. Especially since Sony offered to refund $10 that had been in the gamer's account, and he declined. It looks like he is going to be even angrier, because he is still banned and is probably broke from attorney fees.

Seriously... What was this guy thinking? Hindering other's game play with his foul mouth is effecting multiple PSN users. What did he honestly expect? All I have to say is QQ moar!

I deal with these kind of players on a daily basis. A lot of them would just be satisfied that they wasted the company's time, as revenge. I have to say, they can be some of the most imaginative though. One user told me he "couldn't have been the one to hack" because he was "in Germany undergoing a circumcision" at the time. -_-

Glad to see these kind of asshole gamers finally getting what they had coming to them. Another example of why I don't play online in random matchmaking.

@raychul-this is why I usually play on mute.

A vast majority of my PSN friends are from random matchmaking. You also always know that someone on your ist has that particulat game for online matches. I am just glad he got the case thrown out.

My question is what attorney is stupid enough not to know that the 1st Amendment only applies to government restrictions. The dumbass gamer should at least file for malpractice.
