Earlier this year a gamer filed a suit against Sony, claiming that his ban from the PSN infringed upon his freedom of speech. The male gamer was banned for harassing other players in Resistance, violating the PSN's user agreement.
More after the jump!
Last week a judge came to a ruling on the case. The Judge dismissed the case, stating that Sony was not violating the players 1st amendment rights. The ruling also concluded that typically freedom of speech protects you from the government, not private companies.
The banned gamer was also suing for emotional damages, but the Judge handed that down to the State. After the first ruling, it is unlikely that the Californian gamer will receive anything for damages. Especially since Sony offered to refund $10 that had been in the gamer's account, and he declined. It looks like he is going to be even angrier, because he is still banned and is probably broke from attorney fees.
Seriously... What was this guy thinking? Hindering other's game play with his foul mouth is effecting multiple PSN users. What did he honestly expect? All I have to say is QQ moar!
